1. Who this agreement is with
First State Music is operated by Sander van der Waal, a sole trader (autónomo) based in Alicante, Spain: the same legal identity behind OneMix Mastering. These Terms govern any production, sync/licensing, tutoring, or plugin service booked or purchased through firststatemusic.com. By submitting an inquiry, booking a lesson, or making payment, you ("the Client") agree to these Terms.
2. Services covered
Two services are currently live and bookable: Audio Productions (full track production/composition and sync/media licensing music, priced per track on inquiry) and Tutoring (€175/hour 1:1 lessons and pre-recorded courses, in Logic Pro and Ableton Live). Plugins and Sample Packs are in development: nothing in those categories is for sale yet, and separate terms (including a plugin end-user license) will apply once they are.
3. Productions: ownership and rights
Ownership, rights, and any revenue or credit arrangement for a produced or composed track are agreed in writing on a per-project basis before work begins. This varies by project and is not a fixed policy. Get this in writing before starting, and ask if anything is unclear.
4. Payment and cancellation
Payment for productions is due as agreed at booking. Once work has begun on a production, that project is non-refundable. Tutoring lessons are paid in advance; please give reasonable notice to reschedule; a missed lesson with no notice is not refunded.
5. Client responsibilities
For sync/licensing and production work, you're responsible for ensuring you hold or can obtain the rights needed for your intended use of the final work, and for giving accurate information about that intended use up front.
6. Liability
Services are provided with reasonable skill and care, but no specific commercial, chart, or licensing-placement outcome is guaranteed. To the maximum extent permitted by law, liability for any claim arising from these Services is limited to the amount paid for the specific service in question.
7. Governing law
These Terms are governed by the laws of Spain. Any dispute not resolved directly is subject to the jurisdiction of the courts of Alicante, Spain, without prejudice to any mandatory consumer-protection rights you may have in your own country of residence.
8. Changes to these Terms
These Terms may be updated as the services change, most notably once Plugins and Sample Packs go from "in development" to actually for sale. The "Last updated" date above reflects the most recent revision.
